    I got to know from my attorney that, USCIS has my I 140 information in their system and they gave him a receipt number. But, the receipt is not generated yet. It may take a week or so to get the receipt. My appl was filed on 12th and it reached NSC on 13th.

    I checked the status online with this receipt # and online status shows that they recieved the aplication on 19th and its at Texas center. May be my appl was moved to Texas now.


    wat information does the lawyer/employer needs to give to USCIS to get the receipt number ?
    Can you put some light on it ...

    Shows you the general herd mentality on this forum. As long as everyone is thinking the same way, everything is great. If you differ, everyone will call for a ban on you. They are all lemmings. Unfortunately, I had to come to this forum for news. I have never seen such a bunch of dimwitted people in one place...

    None has called a ban for anyone being differ but it's just the way you express your opinions by using the words like "herd mentality", "dimwitted" etc. Not that you have accepted that you are here for news only, I don't think we need people like you.
    IV is not a news site. It's a group of people who are fighting for a common cause. One needs to understand the common cause is not just helping July filers or people affected with retrogress but a bigger aim of helping all the legal employment-based immigrants. But one also needs to understand that not all the objective can be accomplished at a time and we need to strike the iron when it's hot and make every opportunity count, be it a BEC, retrogression, July filer or Visa recapturing.

    Having said that, I do agree that BEC is one of the issue which should definitely be focussing on next. I'm sure IV members (even if they are not a BEC victim) will support whole heartedly any cause which can bring some relief to BEC victms. What we need is a united front and some unique ideas like flower campaign. Do not forget the flower campaign idea was pursued by one of the IV member who was not part of core.

    I do undersatnd that these companies did not help you.. y don't u understand that we r not talking about u :) the statistics r these companies bring tens of thousands here every year from one country, yes on H1 or L1, not to sponsor them for greencards, but arriving here with a dual intent visa that allows for greencard application is not such a casual opportunity and that's what I'm telling you is rarely available to the equally qualified non-retrogressed folks. Once here, those thousands transfer to these small/mid size companies u mentioned and choose to stay and apply for greencards even though they know that with their huge numbers current rules will make their greencard journey longer..
    Yes adjusting the quota percentages should be on the table, but if these companies hurt you by creating a longer line than the quota allows, , then you should take issue with these companies before you take it at your fellow non-retrogressed immigrants.


    Hello! Infosys, Wipro and all those companies are NOT the main sponsors of green cards, which is the reason we're in this forum, no? Most of the sponsors are US based small and medium sized companies.

    I don't care how many visas they get, the fact is that it doesn't affect me! I neither have a job with them nor I benefited from them grabbing a bulk of visas. End of the day I'm held back because of where I was born.

    Look, this may be hard for you to understand, but just because those companies are in my country didn't and doesn't help me one iota. Everyone's on their own here.

    That is ridiculous. I never said that nor I will. The reason is because those companies MORE people exist in those countries, and THEY'RE CHEAPER and poorer, that's something I do expect you to understand.

    Did stereotyping help you in your discussions earlier?

    I want to ask if I file my labour before oct 2007 am I going to be safe?
    Or I will still come under the merit system?pls anybody will ans this question. I am going to start my GC 2 months(after adv etc)

    You need to file for I-140 before 10/1/07.
    For that you need to have an aproved Labor.
    Bear in mind this is just one of the opinions out there (albeit the most prevalent)
    Nothing is final yet, untill CIR passes both houses and signed by the president before 09/30/07. (Though it looks highly likely now)

    I m Employee of company "A" have a valid H1-B till 2008.

    I came to company "B" through company "A" acquisition. I left company "B" in March 2007 and joined some other company( "C" ) on H1 B.

    Question is- I have a project now and wanted to get back as a employee of "B".

    Will company "A"' H1-B be valid? Or do we have to do a H1 B transfer ?

    Please suggest :mad:

    Ok,

    so the the US lists, the catagories as Mexico, India, china, and the philpines.

    that is 4 counties..... with what ever percentage of the total visas..

    But ROW the rest of the world.....how many countries is that???? i am guessing lots... i personally am only conserned with the UK as that is where i am at the moment. so how do i go about finding the number of visa's that the UK is aloted per year? in EB catagories.


    because i dont see how if say Germay, or Italy used up all there visas for the year, but the rest of the world hadent, or even half and half....how can the entire of the rest of the world be retrogressed.??? is there not a list of how indervidual countries are retrogressed....? if this is stupid please say though, but i think it is quite a valid question.

    I have been laid off yesterday. My employment ends Dec.
    My 180 days expire Jan. My company said they will not revoke the I-140.

    So can anyone explain the steps that needs to be taken by company B after they transfer my h1, for time period Dec thru Jan.

    Can I use ac21 afterwards? and

    Can myself or my wife work on the EAD that will come to our home address?.

    What else needs to be done by company B.

    Will we just get our green card in email.

    If a query comes should I prove that I'm employed with the former company or is it to sufficient to show employment with similar position alone?

    In short if the former company does not revoke I-140 and I take care of the status thru H1b transfer for the 1 month to hit 180 days, will I need to reapply for the GC?

    Please advice to what you think is right based on your best knowledge.


    you need to hope and pray no query for EVL comes until 180 days past your filing of 485. After that if you get a query you can show company Bs letter. the job in B needs to be in the same or similar position.

    While it is terrible on the part of USCIS to do so, but I believe, we have an opportunity to at least get a clear picture of what is going on in USCIS.
    Count me in for a contribution.
    IV Core, please set up a thread to colllect votes for this, give a time frame of 10 days to vote. Then divide equally, the $5000.0 among all those who vote "yes" for obataining this info.
    This is official robbery/bribery, but is our best bet, as of now.

    Yes, I mean, eventually they would get their citizenship. It takes few years, but they will get there.

    Are you sure it is possible to sponsor your nieces, uncles etc if you are permanent resident? Don't you have to be a citizen to do that? I always thought you have to be a citizen to do that.

    Since you have not joined company B then why you worry whether they cancel H1b or not. As long as company A is having your H1b, nothing to worry & no need for reapplying for H1b transfer back to company A. There is no concept of H1b transfer, every company apply a new H1b when you join them and employer/employee relationship exist as long as they don't cancel H1b. Hope this helps.


    My friend has a similar situation.

    He transferred H1 to Company B and worked for 5 weeks and descided to come back to company A (He is 100% sure that Company A didn't revoke / calcel his H1 and he has valid H1 till 2009).

    IS this OK?

    Please help by clarifying...

    Last few lines of this artice is clear about Senate mood. Even IV wants to lobby sepeately for gc numbers IV has to come up with reasonable numbers based on requirement. Arbitary numbers or blanket exemptions will have more chance for failure.

    But unless they can prove that they system is not currently being abused, and unless they can come up with specific figures for the number of visas required, they will have a hard time persuading lawmakers that the cap needs to be raised beyond the current proposal of 115,000.

    What you are saying is a high level picture of what the lawmakers think.

    Instead of asking reasonable numbers asking for no cap.
    True that the tech companies are not comming up with a cap because they believe by saying this, they might be restricted for many years to bring in extra people if they have an opening.


    Before dot com bust even lot of US citizens welcomed H1b persons as there was not much layoffs. But past 7 years layoffs increased to outsource to India,China and other countries. For that they have to hire H1b and L1 persons from Countries mainly India. Those things made anti immigrants hardened their stand. US workers fear that they may lose job if US opens up immigration too much.

    How did the anti-immigrants get a upper hand on this. They are allowing illegals to get an easy path to citizenship.. this will cause a huge influx of people who will benefit the economy but down the line their children will take up the jobs of the americans.. so why a benefit to illegals.

    Now you would say that there are so many companies lobbying for the illegals,
    true but why don't they listen to the tech lobbyist who are few in number but asking what is actually,legally, abide rulles ly necessary to increase the economy.

    Now, I have provided the reference to part of AC21 law with my interpretation, which allows visa portability (unofficially known as transfer) from one sponsor to another and excempt from numeric limits.

    All I hear is "incorrect", "wrong" followed by individual interpretation or opinion. I respect all disagreement part, Which may be/not be accurate. Why don't you quantify your comments with references to law or CIS memo? Don't you think discussion need to be healthy and fair?

    Now, I have a lot of filthy and rediculous offensive messages on the discussion threads with reds, which I would not like to post in public. If this is what our anonymous so called "highly skilled" can bring to the table, then I am speachless.

    Its not personel opinion or interpretation. I know people who have done this.

    Working fo company #1
    Got offer from company X. But didnt join.
    Got another offer from company #2. Joined the same employer.
    After two years applied for extension from employer #2.

    Did not have any issues like out of status. But only thing is, there is no EAD is involved here. Offer from company X did not invalidate the H1B from company #1. Thats the whole point.

    Clearly if you have gap between your H1B and EAD filing, its out of status or unauthorised work. But it has nothing to do the new H1B or old H1B. Even with the same employer its an issue if there is a gap.
