    o.k..I read some of your old posts (but not thorougly) and I was confused (I guess you have done lot of research) - so can you explain again ?
    in yr opinion - does it mean EB3(I) won't go back to april 2001 ?
    I guess by "what happened in 2002 - 2004" - you mean lawyers filed most cases in EB3 ..am I right ?

    I am not saying it will not go back to APR 2001. USCIS can and will do anything. Bottomline is that adverse effect of APR 2001 is practically over except some residual ones ( residual cases also could be in hundreds). So now if uSCIS is taking any category back to APR 2001 it will merely be a game to keep particular catgeory stopped for a while. USCIS need one case to do that and it will surely have at least one case.

    they were not formed at the last moment in most cases
    what makes you think people participate in those? from personal experience
    in the MN chapter, it's hard to even get replies to e mails, forget meetings etc. of late though i'm glad to say the MN chapter has really beugun to pick up again.
    ask the tri state guys how much effort they put locally- meetings- fliers- phone calls, all by a handful of volunteers. so all this is good in theory and yes it takes time. but the apathy (even hostility) that was encountered was frightening. ask chanduv23 someday what the tri state guys went through...

    We had similar experiences in New England too!

    Not to mention cases where people that promised to come didn't show up. In two cases, we had people who didn't even answer their phone calls or reply to voicemails while we were waiting to pick them up from the pickup points! That is just unforgivable! One of these "people" were supposed to be part of our Lobby team!

    I'm a South Indian and I have never had issues with Hindi or Hindi-speaking people. In fact, many of my friends are Hindi-speaking and I'm quite well-versed with the language as well (why not?). You cannot make a blanket statement saying that everyone speaking a particular language is rude or has bad attitude. Just goes to show one's ignorance.

    Just look around and see what's keeping this country together? You can move from NY to LA without having to think twice. Try doing that back home ;)

    Hey, mine is EB2 ROW - can't get any more straightforward than that, I-140 is approved, and PD has always been current! Well, 1 year 7 month and still counting. It would be really easy for me to blame USCIS inefficiencies, but let's look at the whole picture. My second H1 was approved in 1 day (premium processing), my I-140 was approved in 9 days (not premuim processing), I got my fingerprint notice and RFE on I-485 a month after I applied - that means the case was looked at, determined what else they needed, and everything was processed. Work on my AOS case was over 4 month after applying (and I did apply concurrently). Then, I had to wait for namecheck... and wait and wait. Do I blame the processing center for that? No, it's not their fault. Do I blame Chertoff for that? Sure! He is the one who's supposed to negotiate things between DHS and FBI, and make sure things work well together.

    Now, we come to a different issue - quotas. It is obvious that USCIS is not good at all at managing quotas. I am in management, and to me the task of getting within 100-200 approvals on 140,000 quota does not appear Herculean. It's a very predictive process, so theoretically it should be easy to get to right numbers. My take - USCIS system is built in a way that does not allow them to understand and manage the flow of petitions - and forecast how many will be ready for approval in any given month. That's a big flaw, but you know what is the best way to fix it - to relax quotas. Then, they would not have to triple-check every petition to make sure it's current and it is its time to be approved. Having quotas adds a lot of complexity that CIS can't manage. If you look at the immediate family petitions, that do not have quotas, they are getting approved in 3-4 month, so one part of the system works fine, and the other does not.

    No, it isn't NC and NC alone. The percentage of people that get stuck in NC is minuscule compared to the back log due to inefficiencies.

    You can believe what you like, you can chose to in 1 breath quote from the Ombudsman report and then in the next, ignore what it states.

    The fact remains, the USCIS is very far from effcient

    chaanakya, why do you have a problem with the donors? if you don't want to make any monetary sacrifice that's fine...nobody's complaining.     It is amusing to see that there are quite a few people who want the very door closed that they used to enter. It is even more amusing to see that the fault is always someone elses. It is similar to all the people who are opposed to immigration because it is someone elses fault that they are losing their job. Down right funny :p.

    We need to focus on solving our problems without blaming others for our problems. Because once we go down that lane, we are no better than anyone from NumbersUSA or any other organization/ people who are against immigration. It is OK if we do not support increasing H1B - but saying that the H1B program needs to shutdown is not correct. I am sure that one can reason in the same breath that the EB3 category needs to be eliminated so that retrogression can truely be eliminated :eek:

    I am proposing that it is better to completely eleminate EB3 than
    having some kind of false promise of GC.
    I know lots of IT guys from India fall for the Green card promise form employers even now (they say I applied and I should get in 2 years or so..

    By the way I am not "really" asking for H1B to be shut down. I am saying H1B
    in its current form should be shut down. Obviously when the time comes
    to actually shut it down, Corp America will panic and fix the problems.
    In US, if Corp America really wants they WILL get it done.
    In a presidencial election, a canadiate needs close to 100 million.
    A senator needs around 2 million for an election.

    Congressmen need lesser money and thats why they are more listening to local population (and oppose any H1B /EB etc) and can afford to oppose Corp America.

    making illegal a felony and also a fine 50000$ per illigeal worker employer
    employed it was the american chamber of commerce that took out the
    big guns and ofcourse their surrogates/supporters orgaised those

    My company lawyer did the filing for me and I just followed the same instructions to file for AP renewal for my wife. I did paper filing (trying to save a trip to the USCIS office for photo/fingerprints).

    Supporting docs I sent other than I-131

    1. $305 check for US Dept of Homeland Security ( write the A# on the "for" part just for safety)

    2. 2 photographs ( name and A#s at the back , again for safety, in case the great people in USCIS manage to loose the photo from the application )

    3. Valid photo identity ( Passport photo page )

    4. I-94 for both me and wife ( I have a valid I-94 from my new H1B extension, wife's has expired, still sent it)

    5. I-485 receipt

    6. Cover letter ( just stating these docs are attached, and my I-485 pending, please be kind and give me AP ;) yada yada yada ... )


    Hope that helps. My lawyer only wanted my passport photo page and I-94. I know people applying for any kind of immigration document tend to send more supporting documents with the belief "more is good", but I believe ( and my law firm supports) USCIS have all the documents in our files, so it's better to send only what is required and not to confuse the USCIS staff with redundant bunch of documents. Just my thoughts, please, no preaching !

    A friend of mine transferred his H1b from company A to company B. He applied for the H1b transfer and then started working on company B. His H1b from company A expired while his petition was pending with USCIS. He received an RFE after 3 months. Company B responded to RFE but received one more RFE for the previously responded RFE. Now my friend fears that his H1b transfer petition may be denied. Would it be possible for my friend to return to company A and apply for H1b under premium processing even though his H1b with this company expired couple of months back? He has been working all this while on the basis that his petition is still pending with USCIS. Any suggestions or advise would be much appreciated.
    Legally you can start working for company B once you get the receipt.

    think there is no limitation on number of H1's filed for one. so you can go back to company A for the H1 or go to a new company C for that matter.

    and as always get a lawyers opinion.

Veto is not the only thing that a President does although in the current Presidential debate, you will hear about the macho-ism of candidates based on how many bills he/she vetoed, as if to veto a bill Governor or future President will have to lift 500 pounds for the "people's sake".

    Although there is always an urge to over simplify things in real life, maybe because over-simplifying makes us looks good by suggesting easy solutions to any complex situation, maybe that’s why we want to believe that Republicans are better than Democrats or Democrats are better than republicans, easy pick problem solved. But like most things in life, the immigration debate is so convoluted and complex that any one party is not for/against any specific issue. It is very easy to find republicans who are opposed to our provisions and democrats who want us out of here.

    Also, here is a reason why I opened this thread and why comments from Sen. Obama to the question of employment based green card is important. I don’t know much about ever complex politics and immigration, but I am a frequent visitor to this site and learned a lot about the issue during Durbin Grassley bill. In CIR of 2007 had provisions that were designed to eliminate AC21 and visa extension beyond 6 years. If that happens now, a lot of people who really don’t care who wins the election will be asked to leave, in most cases immediately. 2007 CIR was designed by Sen. Durbin. Sen. Durbin is also Campaign Chair for Sen. Obama. Sen. Durbin will drive President Obama’s policy on green card and H1 issue. They may intend to stop so called “exploitation”, but in the process as always is the case, they will be foolish enough to pass such provisions to punish the people that are being “exploited”, which I guess is us. And if they pass laws to abolish AC21 Section 106 (a) & (b) and if they remove 7th yr H1 extension, which at this time is tip of the ice-berg, I hope you can imagine how rest of the things will shape up. My intent of opening this thread was to find out the intensity of Sen. Obama’s reply and see if his administration will be able to withstand an onslaught from Sen. Durbin in preventing any foolish provisions that have not been thought through.

    I guess now you see the relevance of the position of Sen. Obama on this issue.

    And BTW, "interested in legal immigration" is a very lose term. It can mean lot of things. The writing is on the wall, be prepared for the Durbin roll-over in Obama administration. If you are waiting for the green card next year, you was in deep deep very cold water.

    Congratulations to everyone whose dates have become current. To all gurus. I wanted to know as to how does it work when it comes to procesing I - 485, what dates are important is it the filing date, or the Priority date? If two people file at same time with different priority dates who gets priority, one with earlier priority date or one with earlier reciept notice date or will the cases be treated at same level.
