    i thought a simple majority i.e. >50 would make the bill pass through senate. is that not true?

    Its only going to take 5 people to break away from the 64. Those 35 "No" votes are the ones who want CIR dead NOW. They are not going to change. But those 64, its only going to take 5 people to walk away.

    There are 24 amendments. I think atleast 5 people would see their amendments fail on the floor of the house and probably another 5 atleast who would withdraw support because someone else's amendment passed. This baby is going DOWWWNNN this weekend per my estimate. I could be wrong but again, 24 amendments ? That's too many darts on a fragile compromise.

    Here is my list. #1 is unprobable till 2009, so may be we can work on 2, 3, 4

    1. Need a legislation change (to increase visa numbers).

    2. If the above is not possible, recapture unused visa numbers.

    3. If 1 & 2 not possible, exempt spouse and children from visa number counts.

    4. If 1, 2 & 3 not possible, then atleast get them to disclose country wise backlog data, so that there is no "cheating" in visa bulletins

    Excellent thinking. :)

    What should be done to make this happen? Any suggestions? ;)

    Thanks for sharing your experience of on line filling for Advance Parole.

    I thought I should mention that I got my AP papers on May 22, 2009 that is just under one month after my application (4/24) and sending them a letter with following documents �

    1. Bio metric page of Passport, (I guess photo copy of drivers license is also acceptable)
    2. I 797 action notice for your 485 application to prove your 485 is pending
    3. Two passport size photos
    4. Confirmation receipt received after e-filling for AP.

    What PlainSpeak says, whether you like it or not, makes sense (well mostly; I dont understand that . part.. you guys are making me learn something), and is healthy for debate. I recommend you man up and get a bit civil, so we can all at least look good.

    Other companies/coalitions have stopped pushing for temporary H-1B increase as they do not want to be in the bad books of committee chairmen and the leadership offices by trying to sneak temporary relief that divides the supporters of CIR. Leadership wants support for CIR and want all sides to wait for CIR. And not doing so and trying to get interim relief before CIR would put them in bad books of Senate and House leadership, which no one wants coz if CIR fails, then after CIR, these offices will not co-operate with any group that tried to take away support from CIR.     I don't want to oppose IV, but think it this way.. If Microsoft and many big companies asking an increase in H1-B for so many years did not get anything done since 2005, then what are our chances of our voice even reaching them.
    Everyone were so desparatly waiting for the I-485 relief before 15th feb.
    Now that we know that the provisions and their language are decided much in advance, can we know if senate is really going to introduce CIR next month and are inclined towards passing it.

    After reading the complete post, I have come to conclusion that we cannot
    hope confidently that anything can pass this year or in the comming years.

    Dear Members,

    We have worked hard in the last 4 years and have made some progress along the way Immigration Voice Achievements (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) But Most of us are still in the limbo of green card process and waiting in different stages. Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.

    Our angst, our insecurity:

    Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.

    Early effort wins:

    The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.

    How you can help:

    You and help in two different ways:

    Join the advocacy effort in DC on June 7th and 8th. (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1437978-iv-announcement-advocacy-days-in-washington-dc-7th-and-8th-june.html) If you have never done this before, we encourage you to help us with this and join us. Immigration voice will arrange the logistics of setting up meetings and arranging the material for you to take to your Congressmen and Senators. We are expecting about 150 immigration voice members to gather in DC and participate in over 200 meetings with Congressmen and Senators.

    Contributing Funds to help finance the effort (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1534974-funding-drive-iv-needs-your-support-for-advocacy-events-in-dc.html). You are most welcome to come to DC and join us but if your job demands are such that you cannot take two days off on June 7th and 8th, then you can still contribute to this effort by contributing financially to Immigration Voice.     Now I see why you got banned. What you did not realize is others were not rejoicing anything "AT YOUR EXPENSE". They were just enjoying what was available to them. You are the one who wants to make it a zero sum game i.e. gain for others is loss for you and vice versa.

    While others were celebrating what was good for them, you want to rejoice others pain. That is just *sic*. I retract my earlier support for you.

    How long does it take to get the "prevailing wage info"? Does it come from State DOL or the Federal DOL?? I'm from Ohio

    Hi Nat,
    Fragomen took about 6 months in getting "prevailing wage info" for my case in 2001. My manager ( Canadian who had gone through US GC process himself) finally talked to them and asked them to file without waiting for DOL's reply on prevailing wage. (That was a risk but we agreed to take it at that point)

    That six months delay costed me 6 years in GC processing ! But thanks to my manager , otherwise I dont know how many more years I would have waited.(One of my co-worker still awaits his labor cert !)

    The big law firm goes by predefined steps , which are probably the safest way for most cases but may not be the fastest way. You need somebody who has been through this process and can understand and asks good questions to lawyers and can help lawyers to think for your perticular case. Check if you have somebody in your org to do that.

    I filed my labor twice with Fragomen and got rejected in 2001 and 2002.
    Just for H1B visa extension they took more than 9 months. Although they have all my papers for months. Eventually, I had to leave my employer for good.

    Stay away from them if you have choice.

    In my case they took 10 months to file my labor back in 2001. Instead of filing my case in June 2001, they filed my LC only in the middle of Feb 2002.

    Also they never provide any update. Whenever you call them, they are always away from the desk and wanted us to leave a message. Even if you leave a message you don't expect any response from them.

    When my I-140 was approved back in 2006, they filed my 7th year H1 extension. They chose 1 yr extension instead of 3 yrs. I pointed out that mistake 3 times and i never singed the form till they corrected it. It took four attempts to file my H1b extension.
