Sorry that I could not reply sooner. In this case, I went ahead and did an Info Pass appointment. The officer there went ahead and gave a 1-year temporary stamp and said he was ordering card production. This was in July and I am still waiting. My lawyer said "congrats"! No idea how to handle this going forward. What happened to your case?

I agree that porting to EB2 is the best route. But my company was very reluctant to file another labor to port my case to EB2. They thought thur PERM, they may have to hire some applicant if they meet the requirements. The lawyer thinks PERM is risky. I know they are trying to avoid EB2 labor at any cost, though I also know a few friends who had the PERM labor application recently rejected.
Anyway, bottom line for me and others in the same situation is that we are stuck with EB3. And maybe stuck in the rut for a long long time unless something magical happens....

I am new to this and I sent email couple of times and called certain people in IV list.
Most of the responses from the senator/congress members or even conversation refers undocumented immigrants, safe/secure borders etc.
What is missing in representing the EB community different to illegal immigrants ?

In future if someone wants to reach us if you have any question, it is better to directly contact us rather than posting on the forum as we do not read every post.
A couple of people who got the letters have already emailed us and let us all review the letter to see if we are getting what we need from this request. Let us all agree if we want to pursue this and contribute towards this. Once we have enough people, we can go forward.
This is one of the positive steps that we have taken here and glad that we got the response from CIS. So now IV needs to get expose this letter as public as possible to get the USCIS tactics out (senate, congress, president, dhs head and all in the world). And if need be that we all need to contribute to the money they are asking. This is the good one.

I and my wife got our approved EADs in our hand in 17 days (Mailing day to USCIS to recevied date by us). Only strange thing is that my EAD is valid from 06/2008 to 06/2009. I thought the new EADs validity would begin when the existing expires. My existing EAD expires on 09/19/2008. I lost 3 months with this renewal.
USCIS has been unfair in renewing EAD.
What about writing a letter to them? - by grace of God, if they do realize, they may give properly - for 2 years.

My two friends are leaving.
They are completing six years. Their labour is approved. but I 140 is not approved.
They applied for their labour in sixth year.
Due to retrogression they are unable to apply for I 485 and EAD. They are working as DB2 DBA's.
They choose last option to leave the USA.

I am Eb3 Mar 2004 and I am planning to wait until the Oct dates before making any decision.
But there is a deeper problem that I see.
IV had been extremely instrumental in making the immigration issue heard outside our community and taking it to the ears of the people making decisions.
Now, IV, from what I am hearing and am seeing (by openly not supporting the Eb3-I agenda (pappu making comments about what is wrong with the EB3 word petition)
is interested in pushing the Eb2 agenda only.
The core team explanation that Eb2 rollover nos are provided to EB3 and that is why they cannot help it, is baseless.
If everything in the past was to happen as per the process, there would be no IV at all.
Also, in the recent past, EB3 was available when Eb2 was Unavailable, so the rollover argument is wrong.
Now, if IV is definite on not providing support to the EB3 community, it is time to rethink.
I do not have a good feeling about the EB3 to EB2 conversion (it is basically going into unknown territory).

The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!

I have long supported legislation to curb illegal immigration by increasing criminal penalties for immigrant smuggling and document fraud, eliminating the use of government documents that are easily forged, and doubling the number of border patrol guards. Better enforcement and tougher penalties for both undocumented immigrants and their lawbreaking employers are the way to fight unauthorized employment, and employment opportunities are what drive illegal immigration.
Unless we fix the North American Free Trade Agreement (NAFTA) and the Central American Free Trade Agreement (CAFTA) and enforce our own labor laws, we will continue to debate how high the fence should be and how many agents should guard our border � with no real solution in sight. At that time there were 3 million undocumented workers in the U.S.; today there are more than 11 million. In Mexico, 9 million more live in poverty than when NAFTA was enacted. By creating an atmosphere where Mexican citizens feel they have no chance of a successful life in Mexico, these ill-conceived trade agreements increase the number of illegal immigrants coming into our country.
In addition to addressing the forces that are compelling illegal immigration, we must take action to bring illegal immigrants out of the shadows. While I do not support amnesty and have serious concerns about guest worker programs, I do believe our nation should consider establishing a process by which illegal immigrants can eventually earn citizenship. The solution to our immigration problem will not be a simple one, as many things in our country need to be fixed to stop illegal immigration. It is time to take a common sense approach to immigration reform.
The Senate most recently considered immigration when S.1639 was introduced in the 110th Congress. On June 28, 2007, the Senate rejected a cloture motion to proceed to final passage of S.1639 by a vote of 46 yeas to 53 nays. I was deeply concerned about the guest worker provisions in this bill, and voted against proceeding to a final vote. Should these issues come again before the Senate in the 111th Congress, I will be sure to keep your views in mind. Thank you again for contacting me.

Congratulations to all IV members for being able to apply for I-485. This is GREAT news. Please please apply for your I-485 at the earliest. It would be best if your application reaches USCIS in the week of 2nd July. Here is the link to July Visa Bulletin:

EB I is really beaten up and no respite at the corner. And yes, it looks awkward when even late EB2 filers going way ahead ... Of course, no offense...But just wish EB 3 too has the same treatment....
