If you want to file law suite, you should have done that long back.
You should have done it when PERM was brought into process. Also, there is nothing said in PERM process that people should not re-file.
But blaming the process just because every one is made current is wrong. If some one knew the know-how, and was in hands of a good employer, even people who came in 2007 are ready for 485.
The whole immigration system is messed up. It is sad to see people stuck in BEC suffer, but you all had every chance to re-apply and you have every right to be in front of perm people, so is it goes when USCIS is assigning numbers.
Also as posted by members, if all cases would be cleared by 2007 Sep, than you all have high possibility to be in the next VB, which could only be few months away. Also they might bring speed 140 back.

we are a grassroots organization
i think we take pride in the fact that the flower campaign originated at the grassroots. let's not forget though
1. without "iv" as a whole which is all of us, the flower campaign would not be a success
2. flowers alone did not reverse the desicion. a lot more happened including lobbying. don't forget what congresswoman lofgren did...
moral of the story: if we all work together we can succeed, just talk is useless. and a many pronged effort is needed. this is not going to be easy...

This Amendment(1249) is said to have been ordered "to lie on the table" not sure if it is same as the motion to table. But, I think we should hope for an amendment that does not have a table associated with its status.

May be we should try to lobby for a bill with one time relief of Backlog of EB retrogressed.
I feel that once this backlog is reduced, it will be easier for future applicants anyway as H1Bs are reduced to 65000 from last few years.
I request IV core to look into this option as the opposition from anti immigrants would be less for something like this. This has happened once before in yr 2000.

Both of those amendments, if debated, will fail. It will take 10 seconds for Bernie Sanders, Ted Kennedy and Dick Durbin to scream on top of their lungs and kill it. And the reason is very simple. People who have been so successful this year so far in restricting H1 and employment based GCs are not going to miss that nice little H1 exemption at the bottom of both these amendments. Got the same letter from USCIS asking for $5000. If they are asking all the people who sent this request the this kind of money... I wonder how much money they are expecting from this "Program Writing" thing??? IV and We all have to question this insane tactics and this needs to be exposed to press and politicians. I don't think Murthy or AILA or some others do any benefit to us it is already proven many times.

As I promised earlier I would keep you guys updated on the process of this case.
On saturday I received the welcome as a permanent resident to USA letter. After trying to get a hold of my attorney I got in touch with him.
Heres the story. (this guy is a genius)
I asked him how it was possible when my PD wasn't current I got GC approval.
His answer was funny and pleasant. Magic :D
He said after the approval of my PERM during filing I-140 under EB2 he also filed a petition under "person with extraordinary ability interest to US" on my behalf. So in other words both the petitions were being processed together at USCIS. Me not aware of USCIS rules wasn't aware of all the lingo so didn't know.
Now the Extraordinary ability petition quota is always current. So when my extraordinary petition was approved the attorney informed the USCIS that to adjucate my adjustment based on this approval. Since the PD was current for this category. USCIS processed and approved the GC based on that. I love this guy I don't have to work for my current employer anymore hence he will get a big surprise when I turn in 2 day resignation. HA...
