    But skil bill is having permanent increase of GC and H1 and also exemptions will increase further immigration numbers. Though it is a permanent solution to resolve retrogession of pd it will face big oppostion from anti immigrants.

    (1) Will they at least agree to exclude spouses and children from the cap?

    (2) Will they bother to get rid of the provisions allowing filing for EAD even if PD is not current?

    If the above 2 measures survive we will get some relief.

    Also the naming of the bill SKIL and the language is very difficult to oppose.The anti-immigrationists will find it difficult to oppose. Is this wishful thinking? don't know.

    Also it is a politically correct thing for most of the legislators to support SKIL, except for the provisions to increase the H1-B numbers.

    I know you have done a lot for IV.. no body needs to vouch that.. i have seen you in action..but.. i disagree with you on only one thing, calling names.. I understand your frustration, but as a leader you cannot set a bad example...     I have said what I have felt. I am not going to be politically correct, never have been. This is not a forum for pracitising genteel speeches, pampering and politically correct messages.

    If you RSVP that "I will come" and the host prepares entire day for meeting, makes her daughter skip the extra carricular activities, ends up using better part of weekend for an event she is thinking will be attended by you, but you dont show up even and dont even bother to call they you are cancelling, then you ought to be ashamed of yourself. If you do something like that in your workplace, then you will get fired. If you signup for a volunteer training/conference on behalf of your company, get company to book your travel, make them spend time/money and then on day of travel, you dont even show up at the airport and attend conference/training that you volunteered to attend, then you will get fired. You wont get fired from Immigration Voice and there are no personal consequence to your bad, lousy manners therefore its afforable to do so, and so you can do it.

    If you think EAD is the end of the road and you are free now with AC21 options BUT on the contrary you feel more and more need to visit forums here, on Khanna portal, on Murthy's forums/chats then probably you are wrong, you are not free. You are still bound by strings that restrain your mobility and freedom.

    This is for the ones who think that the discrimination based on EB3 or Eb2 is a bigger issue! I would not get into the discussion on why I think that IV is not just about EB2. Also, on our forums it's about reality and not empathy, which everyone should understand.

    Now having said that, please direct your energy towards elimination of country limits rather than fighting a fight which was in your past. Why your company put you in EB3 and not EB2 is not something USCIS or US can control anyways. But when you are EB2 or EB3 with same qualification, experience and expertise compared to someone from say Europe, Australia and many other countries but China, India, Mexico and Philippines than why should that other person get it before you do when you applied before him???? What is America getting anything different from this other person?

    Now talking about diversity for country limits India is more diverse than any other country in the world! And hey, most of them are already here in the country and waiting in queue, how is this helping the diversity?

    What is use of that? At the year end all remaining numbers will come back to India and China. This year they got 9000 numbers all the numbers went in EB2 group. There is no advantages for EB3I. All you can achieve is pulling down the EB3 ROW by years to achieve may be 2 months advancement for EB3I. Best way is put the stricter norms for EB2 avoid the people misusing the EB2. So that these number will flow to EB3 like how the EB2 is getting numbers from EB1.

    I believe cut off date will be Jun 19, 2007.
    Please read page 286, line 40-44 and then read Section 502 d, on page 291 line 40-44.

    I did not know your case particularly but many people like you I know got their I140 cleared and filing I485 now after PD is moved. Still skill bill also does not have anything for persons like you that is you have to wait for your labor cleared. Any bill gives solutions for the persons like you or any lobbying going on? As for as I know no lobbying for these cases like these. Only thing we can do is request BEC to process fast by allocating more funds

    First of all, it is not "my" case. I have been waiting in line for my green card for the past 5 years with my labor stuck in BEC. So, under the current CIR draft, I will be one of the biggest losers as I have not filed for my I-140 and so, my whole application will go down the drain after 5 years of time, money, energy and emotional stress.

    How do you come with a math where I will be able to get a GC immediately after 5 years if I apply under the points system? Did you even read the draft bill? How will I or anybody else for that matter, manage for next 5 years without a GC when they are squeezing out the H1B (fee increase, removal of dual intent etc)?? Next would be the per country hard quota that will put us in an eternally long line.

    I would definitely compare the current mess of a EB based system with the untested point system and take the current system any time as it is a known devil. The merit system is no angel either. Atleast in the current system, if I wait long enough, I know that my turn will come.

    How do you know that process delay would be minimal? USCIS's current delay is not because of process, it is because of the sheer volume of applications and lack of man power. The PERM system takes one month. If you pay premium processing, it takes them 15 days to clear your I-140. So, where is the delay in process? All the delay is from the past backlogs which this bill fails to address and at the I-485 stage where they have to do background checks. That will exist in the points system as well. After you discover the problems in the point system, what will you do then? Ask for another CIR bill??

    You don't have to tell what "my" case is. I live my case...

    IEEE-USA must know the current increase of EB visas in CIR was mainly warranted due to the current backlogs in labor and due to retrogression.
    IEEE-USA when issuing statement like this, should understand that making people wait 5-8 years for adjudication is simply unfair.

    Let IEEE-USA vouch to reform H-1B later and work to clear the backlogs and retrogression first.

    I was a member of IEEE(then eventually IEEE-USA) for 8 years. I cancelled my membership 6 months ago after reading statements issued against us. I have nothing to do with them and I am not going to pay a dime to them in future...

    Appu, I found it! Frist's bill says that for foreign applicants with advanced degrees in STEM from an accredited US grad program (no matter when they graduated), notwithstanding the applicant's eligibility for US permanent residence, the applicant can file for adjustment of status if the applicant has an immigrant petition filed under one of the EB categories.

    This means that the applicant does not have to undergo labor certification at all! This is because for a person that wants to work in the US is only eligible for US permanent residence if the applicant undergoes labor cert.

    See p. 217 of S2454, lines 8-9. This applicant is still subject to the quotas and has to wait for a visa number for approval of adjustment of status.

    Both bills allow "special handling" for applicants with advanced degrees who have worked in the US for three years. I am confused about how exactly that works. My brother-in-law is a college prof and he had to go thru PERM labor cert, though they used the results of his original recruitment and didn't have to file fresh ads. So I am not sure if the "special rule labor cert" in 8 USC 1182 (a)(5)(A)(ii) directly relates to Schedule A.

    But these applicants don't have to wait for a visa number and are exempt from the quota.

    An applicant with a US grad STEM degree and 3 years experience probably can go right to I140/485 concurrent without labor cert and is not subject to Labor cert or any quota.

    Yeah, that's the tricky part. I think all professions that require advanced
    degrees in STEM have been classified (by Section 406) as Schedule A.

    Which means you file ETA form 9089 directly to USCIS NOT to the DOL.

    That's the "special labor certification" that the Specter mark-up refers to.

    The PACE act doesn't have this provision - it excludes future F4 visa graduates from labor certification but says nothing about the current advanced degree holders. Frist's bill seems to exempt all those with advanced degrees and are employed in their field of expertise from going to the DOL for certification. Plus, if you have been employed for 3 years or more, then the quota doesn't apply and you get a visa number right away.

    Some people advise to wait and watch and some people ask to do something else. I would like to say one thing and it is purely my perspective. People who are waiting inline for 8-10years does not know when they will be getting their GC in hand. May be in next four to five years. By that time on average their age will be around 35-45.

    Do you want to wait 4-5 years and do the job which you were doing 10years back?

    Did you had any vision for your career when you started your GC and life?

    Do you have the same vision now for your career and life?

    Did you feel you and your family have sacrified enough in your personel life for this stupid GC?

    IF YOU SAY I HAVE DECIDED TO GO BACK TO MY HOME COUNTRY:

    Do you think you will get a managerial job if you go back to india at the age of 40 when you could see guys @30 doing that job with ease and with better experience?

    Do you think becos of 10+years of expereince in programming field, indian companies will recruit you for managerial job?

    Are you willing to work in India as a programmer with 10+ years of US exp under a 25-30 year old team lead or PM ?

    If you say YES , YES , YES for all the above, do you think any indian company will recruit a programmer at the age of 40? forget about the salary you are going to ask for your exp which they will never accept.

    So at the end if you wait long enough for GC, then it is better to wait here until you get it. At least you can save your life though you have to start your career from -10years. If you quit and decide to go back to your homecountry, your life is going to be tough.

    Options for guys waiting for 8-10years for LC:
    1. Try to get PMI Certification, CISA certificaiton.
    2. Try to get TOEFL, GMAT scores and keep it ready.
    3. Try to get in contacts with most of your friends and manpower agencies in India.
    4. If you file for your 485 in next one or one and half years, then proeceed with MBA plans(parttime or full time or executive MBA) in top 25-30 business school.
    5. Your waiting will yeild fruit in this country only with MBA as in next 10 years, US will need more managers than programmers to manager all their outsourced projects.

    6. If you do not have such vision and you are happy with what you are doing now and if your job is secured for next 100years and if you feel that you will be happy in future by doing the same job and OK with other kids going up the ladder stepping on you and if you are ok reporting to them and listening to them, getting bashed by them etc etc, you can very well wait for next 100 years hoping to get GC one day.

    I am not talking about one guy in one corner living beautiful life.
    I am not talking about guys who are lucky on everthing to get on time including GC.
    I am talking about majority of the people and general human nature, people who came to US with a vision for their career and life. People who have had and has a spark in their eyes.

    I disagree with you. I will try again but you can continue to disagree with me.

    Guy from ROW joins Company A in 2001. The Company A files his EB2 ROW in 2004.
    Guy from Retrogressed Country (India/China) joins same Company A in 2001. The Company A files his EB2 India in 2004.

    Both guys are brilliant and have same talent.
    ROW guy gets approval in 2005, while Retrogressed guy has not got approval even in 2010.

    ROW guy gets promotion and moves up in the ladder in 5 years from 2005 to 2010, while Retrogressed guy cannot move up the ladder even though he qualifies for the promotion because he does not have green card and is required to maintain same or similar job.

    Agreed immigration is benefit. But immigration laws should apply equally. It cannot be the case that people from only few countries are retrogressed by 5 more years than the people from all the other countries, which causes people from few countries to be at disadvantage at work.

    It would have been fine legally if people from all the countries had to wait for green card for same amount of time, even for 10 years because immigration is benefit.

    I think when the law was designed this situation was not considered. Hence, I think the law as it is has had an unintended consequence of discrimination at work.

    I therefore think if someone with EB2 from 2004 or EB3 from 2002 has a good chance of convincing EEOC of work discrimination because

    CAUSE:
    1. He/She is required to have same or similar job; AND
    2. He/She is qualified for the promotion; AND
    3. People in his/her group and in the same/similar situation who were from ROW received their GC at least 3 years earlier and have got the promotion; AND
    4. People from only few countries are retrogressed; AND
    5. The only reason for his/her not receiving the GC is visa number unavailability because of country quota and there is no other reason

    EFFECT: (though unintended)
    He/She cannot get promotion; while his collegue from ROW can i.e. People from only few countries are at disadvantage at work compared to people from ROW.




    You are missing the key point here.

    Equal Employment Opportunity applies only to applicants who are eligible to apply for that job. It does NOT apply to immigrant visa allocation and any other visa benefit such as H-1B approval.

    In other words, Equal Employment Opportunity is applicable to US Citizens and residents with work authorization (Green Card holders, EAD holders, person with H-1B approved) and this is limited to job hiring, job promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment. This does not extend to immigration benefit or opportunity lost due to lack of immigration benefit (such as I-485 approval).

    As I was explained SSA do not classify Economic Stimumus Package as a Federal Benefit. For them Federal benefit is a recurring payment of certain amount and the Stimulus package is just one off.

    Also, we should try and get our message across to IRS about dependents who can not have SSN due to the nature of visas issued (H4). IRS should update their system so that if first person filing the return has valid SSN, payment should be calculated as it would be if everyone has SSN. This would be lot more easy then issuing SSN and then filing 2008 returns with those SSNs.

    Any thoughts/ feedback?

    sorry, i missed the obvious. In the links i posted earlier and also on I-131 instr page, it clearly states that Bio-Metric is a must for 1) Re-Entry doc and 2) Refugee doc, but not Advance Parole. duh! :-)

    did you see any of the debate on CSPAN? I unfortunately sat through most of it, and the vitriol that people like Bernie Sanders and Dick Durbin have spewed on H1Bs has left me a bit shaken and a bit bitter. Forget about taxes, we are paying into medicare and social security (which we wont get to use) all these years and yet we were treated like trash. At the same time the red carpet was laid out for illegals who have not even paid taxes, have broken multiple laws...

    I dont know if there was even a 5 minute period in the senate where someone said something positive about the contributions that H1Bs have made here. I doubt if we have any chance of getting any favorable amendment in this atmosphere.

    It felt as if we went into a massive swordfight (Kill Bill style) armed with toothpicks. The fact that we got away with just scrapes and bruises is victory in itself.

    And why is the flying so terrible these days?? because the airline industry is the least profitable among all industries. Most are bankrupt or on the verge and the people working there are all tensed about their jobs. It is the worst time to be in airline industry. Our only hope is that the certification agency (if there is any such thing) makes sure that the industry uses aircrafts which are checked thoroughly and in operatable conditions. They arlready are completely negligient on customer satisfaction (everybody customer+industry officials know it). Hope they are not negligient regarding safety standards.

    I am on 8th year H-1B extension and my labor certification application
    is pending at PBEC for 4 years..
    Got Laid off....from my current employer...What are my options ?

    a) Can I get an H-1B from another employer and apply thru PERM.
    b) If I apply thru PERM from another employer B and my labor is approved from my current employer A(the one that laid me off)...can I apply I-140 from the employer A ?

    Guys...Pls let me know you thoughts ...It is very critical for me...
