Hi friends,
My EAD was about to expire in 4 months. I'm going to apply for the renewal. Can I keep working if the application is pending?
You can work as long as the EAD is valid. If you meant to ask if you can legally work while your old EAD has expired and your new EAD is pending, the answer is NO.
One more thing, the USCIS is required by law to make decision on your EAD application withing 90 days upon receiving your application. But someone didn't get that within 90 days. That casused problem bacause you can only apply for renewal of your EAD if it is 90 days or less before your old EAD will expire.

I am on 6th year and need to extend my h1b. My lawyer informs me that 45day letter from Backlog center is enough for 7th year extension.
I thought we need to get the screen-shot of pending labor as a proof for 7th year extension.
Does anyone got extension based on 45day letter for the 7th year or beyond....???

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

If the hospital (healthcare organization) is a non-profit body then they will not be subjected to the quota (I think). Maybe other members can validate this.

I am July 2nd filer at NSC.
I got my EAD approved from NSC on 25th. I see a message-- card ordered. Today there is one LUD , approval notice sent.
Is this common

I have done so and did not find any additional issues as compared to H1 upto I140 approval.
I am filing for I485 in July.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. I am working on H1B and I already received my EAD and AP on november 2007. During I-484 filing I have not included my wife in my application because of personal reasons. But now i want to file it for my wife in another 2-3 months. Mu queation is that can she travel out of country on her valid H4 visa status while i travel on AP. Will it effects her reentry because I will be using my AP for travel and she dont have AP. Please answer my query.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

Hi,
My husband and I work for a large MNC. We have our own L1's. Currently my husband's L1A is under processing. There is a RFE on it.
I want to know if we can change the status for him from L1 to L2 or to H1 without he having to leave the country?
If so what is the process to do it?
Can I apply for his L2 while his L1A is under processing?
