Need help
I have approved labor for PD 2004 and I-140 got rejected in Dec'2006 due to education credential with 3 year degree. currently my I-290 is pending with AAO appeal for more than 10 months and my extension is based on that.
New labor is filed in June'2007 and got approved in September. I-140 is pending for the new labor.
My Current extension is getting expired in January 2008. If I get premium processed my extension on old case and if my appeal gets denied will my extension or my status gets invalid or I have valid extension upto next January to get other I-140 approval ?
Please let me know ASAP so I can request premium process for extension.

Keep new approved H1 and all related documents with you for POE, also EVL.
I enered POE twice in similar situation as yours without new stamping.
Both times POE (Atlanta) experience was good for me.
I just entered even after new USCIS memo.

Did anyone notice that Compete America seem to have changed its website recently? I visited their website after sometime and it seems that they changed it recently.

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

1)Company A (GC sponsoring company) filed H1B 3 years extension based on approved 140 six months back and it is pending since then and got RFE .My previous H1B expired 3 months back.
2)Now i would like to switch company B by using AC21 and want to file H1B renewal also with company B.
Is it possible to file H1B renewal with company B by using pending receipt notice of H1B (that was filed by company A)? or do I need to wait until get H1B approval that was filed by Company A?
Experts please suggest?

My friend approved PERM in EB2 have qualification 3 year B.SC + 1 Year B.Ed + 2 year MSc. total 6 years of college, filed I-140 and was denied because of education. The labor is for Masters with 0-1 year experience. But they want 4 year degree prior to masters, citing EDGE database. Now the appeal is with AAO.
My question:
1. Do he can apply with the same labor for EB3 ?. What is the chance with two I-140 with same labor ?
( He filed I-140 for EB2 with that labor before 6 months of PERM certification. The PERM certified on April 2009 )
2. Or he need to do a fresh PERM with EB3 as a backup till the AAO verdict ? (takes 22 months)

I want to know if i can get a GC without the labour filing. I am currently on L1A visa, but i came into US initially on H1B visa. Given below are the details
H1B petition approved on: 10/01/2005
Entry into USA on H1B : 04/23/2006
L1A petition approved on : 09/23/2008
Different people tell me different things, some say i will still be considered as H1B and hence have to go through labour filing since i entered USA in H1B status. Some say since my current visa is L1A, i qualify for EB1 category and hence labour is not required and i will get the GC in 6 months. Not sure what is true.
