We are among the July filers. TSC applications went to VSC and back to TSC. My wife and I both got our EADs. Social Sceurity office told my wife that her A# is bringing up someone else's data. We went to Infopass, but it was of no help and we were adviced to contact or write to TSC. We placed a service request by calling the national phone number. That was more than two weeks back. Nothing has happened yet. All three applications - 485, EAD, AP has the same wrong A#. Her EAD is of no value without the correct A# that has to be rectified at the 485 stage and then EAD. Any suggestions?

When I was on F1, I was able to get my EAD by going to USCIS office. Not sure if we can do the same thing after filing I-485

Hello All,
I am starting my employment based GC process. My employer is going to file for my labour certificate (LC) thru PERM soon.
However, I want to know what happens if you Labour Application is not approved by USCIS?
like - Can you then apply for Labour thru another employer? or start ur Green Card process thru another employer.
- Can you get H1 extension after 6 year period is complete?
Kindly advice.

I am planning to port my existing priority date from EB3 to EB2. I just wanted to understand the risk I am taking. Could you people do let me know the impact on my exsting PD(EB3 with approved 140) and future 485.
If in case my EB2-140 with PD porting doesnot go through...

I have been in the US for a couple of years working on an E-1 Visa. I am now filing my I-765 because my Visa is tied to me working for a particular company and is not transferable. I have a social security card.
I am now not sure if I should fill this out as if I am applying for a or b:
A) Permission to accept employment
B) Replacement (of lost employment authorization document)
C) Renewal of my permission to accept employment (attach previous employment authorization document). Form I-76
If it is C, should I attach a copy of my E-1 Visa and my Social Security card or something else?
Also, for question 11 (Have you ever before applied for employment authorization from USCIS)? I don't think I have. I think my E-1 Visa came with this right and that I only dealt with the social security office.
Please help if you know the answer

New/amended 140, if the LC states correct job requirements (assuming the mistake was made on 140 application).
New LC if old LC states incorrect job requirements.
I have a Masters Degree in the US and the 5 yr experience required for the EB2 also the position requires it; however my lawyer made a mistake and asked for an EB3.
I already received my I-140 and my I-485 was filed at the same time.
What can I do to change to EB2?

Hello,
I applied AOS in July 07 and was waiting for my and spouse FP till now. Last week I received FP notice for my spouse but her middle name on FP notice is spelled wrong. But her I-485 receipts and EAD are spelled correctly. What do I do ? Do I need to contact them and have it corrected before she appears for the FP appointment. Her FP appointment is next week so there is not much time left. I was thinking , that when she appears for FP appointment to let them know about the spelling mistake.
Members, please share any similar experiences.

The Memphis Commercial Appeal reports on today's citizenship swearing in of Irish-born James Patrick O'Donnell. Mr. O'Donnell immigrated to the US at the age of 4 in 1926 and fought for our country in World War II and won a Bronze Battle Star. In 1987, Mr. O'Donnell applied for a passport to go on a cruise and was told that he was not a citizen despite his clear recollection of being naturalized before shipping out during the war. How do i file extension for H1b ....my h1b expires tomorrow..can i do it online...this is the first extension...
wow...you are the man. What were you doing till the last min. I am not sure how you can do that. But from day after tomorrow, you are simply out of status. Contact your company's attorney ASAP. It will take aleast ten days to prepare the papers. My opinion is don�t screw up trying to file yourself. Because you are running out of time...

Company A filed my PERM in Sep 2008 showing 5 yrs job experience as of April 2005 .
I joined Company B citing 6 yrs job experience as of Dec 2009 due to various reasons.
Joined Company B in Dec 2009 and have H1b valid till April 2011 which is when my 6 year period ends.
My issues are:
1. If Company B files for my 7th year extension using the pending PERM, will the job experience discrepancy pose any problems ?
2. Does Company B have to know all the details in my pending PERM or just the case number to use it?
3. What is the earliest Company B can apply for 7th year extension?

Yes, as long as the new job is same/similar to job B. The 180 days count is number of calendar days i-485 is pending, not number of days on the job. One may not even be working at all during that 180 days, or even while waiting for i-485 approval however, must have a very good excuse because IOs will be very suspicious. It is not violating any rules though as i-485 is for future employment.
