I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

My priority date is not current.But today in USCIS status check I saw that I got a RFE.what does it mean?Why they are processing my case now?

Does BEC Capture the following information at the time of entering data..
Type of application � Eb2, 3 or Other workers category..
Nationality of application..
My understanding is that BEC does not determine the EB2 or EB3 until the final stage, nor is the nationality captured as part of the older labor process (I could be wrong.).. and if the nationality is captured then an application of an Indian can only be substituted by an Indian???
In case they don�t,,, how can DOS determine the all the 245(i) applications at the BEC are Eb2.. or Eb3.. or for that matter from India. On an optimistic side.. when all the cases at the BEC get cleared in June 07 and DOS realizes that bulk of the cases were for Other Workers Category .. may dates for EB2 and EB3 could make huge movement forward then..

That would be 245(i) - ability to file for AOS with more than 6 months out of status by paying a fee. Most people here would be opposing this ammendment because of some "moral" issues. Well, I hope they have never been out of work while on H1.

I just missed 120-90 day window for filing EAD. My EAD expires on oct 12 and today is July 12TH.
Other stats:
Have H1B active with current employer till Feb 2009
Just got my priority date current - EB2 July 2004 for India
I-140 approved, I-485 and I-140 filed last year receipt date Sept 2007
Questions:
How can I get new EAd now?
I can continune working on H1B correct?
Any impact on my 485 application that now will process due to PD being current?
PLEASE HELP. I am confused and worried a bit.

Keep new approved H1 and all related documents with you for POE, also EVL.
I enered POE twice in similar situation as yours without new stamping.
Both times POE (Atlanta) experience was good for me.
I just entered even after new USCIS memo.

I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?

I'm currently getting everything ready to mail my forms to get a green card through marriage. I've heard that I would have to send an employment verification letter from his boss. But some people say it's optional, I only send it if I want to because he's already got his taxes done proving he can afford to support me.
If I do have to send the letter, do I need anything else along with it as proof? Either to mail them alongside the letter or for the interview?
Any help will be much appreciated. I've heard conflicting stories and don't know what to think.

If I apply for H1b in April, 2008 and choose consular visa processing, and the H1b starts in Oct, 2008. Do I have to go to the consular for a H1b visa? I might receive a EAD from 485 before October, and if I do, I would like to use EAD but keep the option of H1b open.
Can anyone answer me???
Say I don't activate my H1b in Oct 2008, but H1b is valid for three years, does it mean I can activate it any time by going to the consular for a H1b visa from 10/2008 to 09/2011? Of course I will keep my status valid (AOS) throughout the period.

Sending Personal checks do not matter. Most attornies collect the application fee from us and send their checks to USCIS. I sent my personal checks to DHS.

Your passport has nothing to do with you invoking AC21. AC21 is just a way of informing Uscis that you are switching to another job with similar duties, that's all. There's no official form or application to submit.
Just apply for the renewal of your passport as you would usually do. That's all.
