    Doesn't it sound rude... they celebrate, feast and we fast. If we admire this country for giving us so much we should also show our support and adopt the culture and celebrate with them to show we are tax paying Americans who enjoy in American way.

    We can show our protest by sending 1-wish for our own GC ( may be in the form of Christmas tree ornament) to all law makers. Everybody makes a wish and our wish is GC.

    Hi All,

    Andrew Dutton - 917-536-5940, immigration_counselor@yahoo.com is my attorney for green card. I had also used him before for H1B renewal, PERM & I-140 substitution with DOL (while case was pending with Backlog Center). He is very professional, humble, and always answers phone calls & email messages immediately. He is also very very affordable (shall I say inexpensive - see the amounts he charged me for H1B, green card processing etc below).

    I was one of the unfortunate ones who got scammed my Earl David Associates (New York Law Firm) - now renamed to Jed David Philwin Associates. I know how bad law firms can be - they did not file my LC in 2003 but kept on telling me that they did - ONLY a year after in 2004 they promised me they had already done so. Needless to say how much pain suffering this caused me.

    I used Andrew for my H1B + wife's H4 renewal - total attorney fees - $550. No extra fees for filing documents for family members.
    Then, I used him for EB2 PERM, I-140, I-485/EAD/AP (for myself & my wife) - total attorney fees - $1600. No extra fees for filing documents for family members.

    I had an existing LC approved from Backlog Center - he filed I-140 for just $100-$150 attorney fees - stating that since he had already filed a previous I-140 for me - he just needs to modify some minor details on the I-140 & file it.

    He filed my I-485 over the weekend so it reached USCIS on Monday July 2 - who knows I may be one of the lucky ones when July visa bulletin fiasco is resolved.

    Fierce Battle Brews Over Comprehensive Immigration Reform and Difficult Road Ahead

    Report indicates that the comprehensive immigration reform battles are getting growingly passionate over the illegal immigrant issues among the different political forces and some news agencies question whether the Congress will be able to pass such legislation before this year is over. The real battle is waiting in the House of Representatives and reportedly the restrictionist members of the House are organizing and mobilizing their forces to oppose any bills that will give any relief to the illegal aliens including the temporary guest worker program and the earned adjustment of status of the illegal aliens to permanent residents. There are some indications that some of the House members favor the Frist bill over the Specter bill in the Senate because of the illegal alien immigration issues. The Frist bill does not offer any relief for the illegal aliens and proposes to reinforce the border security and immigration enforcement. Meanwhile, the Specter bill proposes the temporary guest worker program and earned adjustment of status along with reinforcement of the border security and immigration enfocement.
    When it comes to the reform of legal immigration, particularly the employment-based immigration, there appears to be no noticeable battle among different political forces. Indeed the Frist bill and the Specter bill agree each other in almost every detail in the direction of the reform. However, the Chinese and Indian immigrant communities are currently battling with these bills over the provision that restricts use of the per country immigrant visa numbers for fear that such bill will not be able to relieve current employment-based visa number retrogressions for India and China regardless of increase of the overall employment-based immigrant visa quota, recapture of unused immigrant visa numbers, and other provisions that exempt several employment-based immigration related groups from the annual numerical limitation, including family members and certain advanced degree holders.
    It is our view that the direction of the employment-based immigration system reform should focus on removing the clogs to the pipeline that supplies the needed foreign workers at both high-end and low-end. The reality is that these foreign workers are supplied primarily by certain countries. The statistics reflect that most of the high-end professional workers come from India and China. Considering the fact that it is the sense of the Congress and the nation that this country needs continuing in-flow of foreign brains as reflected in the special provisions relating to the advanced degree foreign worker immigration, the per country limit in the employment-based immigration quota system will work against the achievement of these primary policy goals since it will create another clog to the supply of foreign brains from the primary sources of these brains. It is proposed that the Specter bill is amended to remove the per country limit and the Senate passes the comprehensive immigration reform bill without imposing per country limit in the visa number allocations. In formulating the nation's policy, the Congress cannot contract itself in the same legislation.

    I have been speaking to colleagues and friends. Not many were aware of the rally others didn't think it would make an impact.After I showed them the website and BBC news article they were listening. I was hesitant to come there now that i was there i will attend a 2nd, 3rd and everyone. People in different parts of the country should lobby and bring 20-30 people and then you'll see numbers. Before the rally run some ads on popular channels and newspapers and motivate them.

    I BEG to differ. I called USCIS today morning and the rep told me VERY CLEARLY that ANY application received on July 2 will be ACCEPTED as July 2 is the cutoff.

    A few min later my spouse called and they told her, Everything would be rejected.

    USCIS customer service center, currently cant differentiate their A** from a hole in the ground!!
    hilarious!!!!

    Dear IV members,

    We are seeing now the fruits of our efforts.

    Despite a difficult year for immigration, there is movement of Bills for us.

    The admin fixes campaign has also been successful. It is now a matter of time when administration chooses to make an announcement. We have been following up with them on regular intervals. The phase 2 of our campaign has also been going for past several weeks. Several state chapter members have traveled to DC and lobbied. Core has also traveled to DC to push for our provisions.

    The latest good news is the bill on Recapture. IV has been on the front lines to announce all these developments and our lobbyists have been lobbying hard for us. All this effort costs money and thus we are starting a funding drive after a gap of 4 months so that we can continue this momentum. The more we can raise, the better we can lobby. We have a target to reach at least 50K in this funding drive so that IV can continue to be a voice of immigrants and take up their issues on the hill.

    That 2% could be an extremely conservative estimate for 2001-2002 filers. Why ? Many filers are already been approved. The only filers that are left are probably who got their LCs between 2004-2008 with priority date in 2001/2002 and labor substitutes .(note in 2005, the PD of EB3I did come all the way to June 02). Most of left outs have filed their 485 in June 07 already and you could probably see a huge percentage in too, because by then people knew about the website and started tracking.

    I hope you are correct but look at for EB3-I.
    There are about 14 pages of EB3-I before 2004. So with assumptions of 2% applicants registered on there will be approximately 30000 to 35000 EB3-I applicants.
    (14*50)/(0.02) = 35000

    Hi folks,

    Here's my situation:
    Currently applied for 485 and waiting for receipt
    Will be applying for EAD/AP this week.
    I am working Company XYZ, in State A, City A currently and will be transferring to State B, City B within the same company, with the same job designation/description etc., absolutely no changes on that front and virtually no change in salary but in compliance with prevailing wage etc. for State B, City B.

    Also the transfer is not going to affect my 485 because of my 140 which said "relocation within the US may be necessary" and this was expected when I started my GC.

    The issue is with a technicality - my PERM was for XYZ, Inc and the same company in State B is called XYZ Engineering Inc, technically 2 different companies and that's because every state has its own rules as to how a national company can be registered/operated.

    Coming to my question re H1B:
    My corporate attorney says that due to this technicality, my H1B needs to be AMENDED which according to my GC attorney is the same as applying for a new H1B but not having to wait in line. My question is whether this will have a negative impact on my pending 485/EAD/AP in any way.

    Please advice. Anything will help.

    Jaime, your thought of having one more rally in Silicon Valley is a good one but again you are going to have the same crowd..!!
    People in neighbouring states of DC did not make it , you tthink they will make it all the way to west coast! very doubtful!!
    We should aim at bringing in more people to this family as possible..
    Looks like a simultaneous rally on a weekend will be very effective!
    And this time for the rally we will carry one one slogan banners
    'SHORTEN THE WAIT FOR LEGAL IMMIGRANTS' or something similar!

    While we are at discussing participation, a question I heard at DC comes to my mind. A member ( anil_sap?) asked another Texan member ( forgot name) - 'What takes you to become an Active member?'. To which my friend answered - 'Isn't he active alredy. He is here'.

    That made me think - is being active a nebulous concept. Who's is the real active member of IV? The Core and near-core that strategize, plan , co-ordinate and conduct the business? The guys subscribed to monthly payment but missed DC? Guys who were at DC but not monthly contributors? Guys who were there all 4 days? Guys who visited for a day? "Lunch-Break" agitators? Who is 'active' among these will depend on whom you ask!

    The following portion is in humor. Don't take it in bad spirit.

    I did a self-evaluation, and guess-what, I realized I was a different breed. A 'Know-Nothing' IV member!

    Being a IV member

    1) Do I know why was such a mass mobilization done on that particular day? Is it because there was a push for STRIVE act as speculated in the forums here? Or is it SKIL we are pushing?

    Ans - I KNOW NOTHING

    2) What is the criteria for getting selected for Lawmaker meetings? Why weren't some selected after following the USCIS-inspired process? ( inspired by Marks skit)

    Step 1 : Submit Labor petition E-IV-LOBBYDAY ( twice)
    Step 2 : Verification by Labor department (or is it Name check)
    Step 3 : Receipt Notice ( Talking Points)
    Step 4 : Waiting...
    Step 5 : Followup with RO (Rally Officer). You are still under Processing Time
    Step 6 : Waiting...
    Step 7 : More followup..
    Step 8 : Retrogression due to insufficient (visa) numbers

    Ans - I KNOW NOTHING

    3) Didn't some members from my state attend Lawmakers meetings? What was the result? Where they positive or negative about our cause? What should we do to followup with them?

    Ans - I KNOW NOTHING


    4) What does it takes to become an 'Active' member as defined by Anil? What will take for IV to trust a member enough to let him know of the purported plan for World-Domination? Or should we just remain content gossiping (with near-core members) and making our own guesses?

    Ans - I KNOW NOTHING

    5) Does my State chapter even exist as of today? Or is it an IV version of Flying Sphaggeti Monster, that we should worship without questioning?

    Ans - I KNOW NOTHING

    With so many 'KNOW NOTHINGS' to my credit, I feel like the member of a secret American political party in the time of the Whigs.

    i think this is the same guy who created a huge fuss on july 2nd when we found out that all 485s will be rejected and said that we all deserve it since we did not "remember" people in pbec.

    do u want to go thru somthing like that again....by unbanning him?

    hahaha. i also remember one guy telling everyone on this bbs to not file till July 29, so the PDs remain current for August. some one later found out by reading his old posts that he had already filed his 485 :eek:

    Also, as we know the severity of the retrogation is not completely due to visa number unavailability. USCIS never used the full 140k - many years - due to the inefficiency of their process, FBI name check backlogs, may be work force shortage etc. We are beginning to see some improvements in those areas. There is an increased awareness of EB backlogs due to efforts of IV. I would say, the future is looking promising.
